Property Taxes, Association Fees, and Homeowner Insurance

Property Tax Warning
Pursuant to Florida Statute, § 689.261, “(1) A prospective purchaser of residential property must be presented a disclosure summary at or before execution of the contract for sale. Data Source Disclosure
Homa AI sources data from public records and partly from third party providers who likewise source data from public records. One of Homa AI’s third party providers is AnyProp, Inc. which requires the following disclosures:
All of the information obtained by the user from Homa AI’s platform, website, and service via and through AnyProp is intended only for user’s internal use and use by clients of the user, and may not be disseminated or reproduced without permission from AnyProp;
The user represents and warrants that: (i) the user will only use Homa AI’s platform, website, and service as authorized in writing; (ii) user will comply with the restrictions set forth in these Terms of Use; (iii) user will not sublicense, lease, or resell Homa AI’s service or any data therein except as expressly permitted by these Terms of Use between Homa AI and user; (iv) user will not copy or redistribute any of the information provided by Homa AI’s platform, website, and service except in connection with user’s consideration of the purchase or sale related to real property in which user is interested; and
User acknowledges the applicability of the Multiple Listing Service ownership of and validity of the MLS’s copyright in the listing data, and user acknowledges that neither Homa AI nor AnyProp, or any other licensor, make any representations or warranties with regard to the data provided through Homa AI’s platform, website, and service.
Dispute Resolution
Prior to filing or commencing any litigation in any court, the following pre-lawsuit procedures are mandatory conditions precedent: (1) The user is required to mail a letter by certified mail, return-receipt-requested, to the principal office of Homa AI, Inc., attention management, explaining the subject matter of the dispute or claim and provide Homa AI, Inc. a time-period of 30 days to respond; and (2) If the dispute is not resolved informally in the foregoing manner, then both the user and Homa AI, Inc. must arrange and submit to nonbinding mediation via the services of a Florida certified mediator; and (3) If the dispute is not resolved through mediation, then the user and Homa AI, Inc. must arrange and submit to binding arbitration through the American Arbitration Association (“AAA”), by a single arbitrator, and the arbitration venue must be the AAA’s office location in Miami, Florida.
Florida law and U.S. federal law, to the exclusion of any other laws of any other jurisdiction, shall apply to the resolution of disputes, claims or controversies by mediation, arbitration, or litigation.
To litigate claims, in law or in equity, arising out of, based upon, or involving a federal question under U.S. federal laws or where jurisdiction is based on diversity of citizenship, the user agrees to submit to the personal jurisdiction and venue of the United States District Court for the Southern District of Florida, Miami Division, in Dade County Florida, as the exclusive venue. To litigate claims, in law or in equity, arising under state laws, the user agrees to submit to the personal jurisdiction and venue of the 11th Judicial Circuit Court in and for Miami-Dade County, Florida. The user hereby waives the claim or defense that the foregoing courts constitute an inconvenient forum, and the user stipulates that the user has had minimum contacts with the State of Florida, Miami-Dade County, such that the user anticipates and intends to resolve any claims, litigation, or disputes by litigating in the State of Florida.

Dispute Resolution
Prior to filing or commencing any litigation in any court, the following pre-lawsuit procedures are mandatory conditions precedent: (1) The user is required to mail a letter by certified mail, return-receipt-requested, to the principal office of Homa AI, Inc., attention management, explaining the subject matter of the dispute or claim and provide Homa AI, Inc. a time-period of 30 days to respond; and (2) If the dispute is not resolved informally in the foregoing manner, then both the user and Homa AI, Inc. must arrange and submit to nonbinding mediation via the services of a Florida certified mediator; and (3) If the dispute is not resolved through mediation, then the user and Homa AI, Inc. must arrange and submit to binding arbitration through the American Arbitration Association (“AAA”), by a single arbitrator, and the arbitration venue must be the AAA’s office location in Miami, Florida.
Florida law and U.S. federal law, to the exclusion of any other laws of any other jurisdiction, shall apply to the resolution of disputes, claims or controversies by mediation, arbitration, or litigation.
To litigate claims, in law or in equity, arising out of, based upon, or involving a federal question under U.S. federal laws or where jurisdiction is based on diversity of citizenship, the user agrees to submit to the personal jurisdiction and venue of the United States District Court for the Southern District of Florida, Miami Division, in Dade County Florida, as the exclusive venue. To litigate claims, in law or in equity, arising under state laws, the user agrees to submit to the personal jurisdiction and venue of the 11th Judicial Circuit Court in and for Miami-Dade County, Florida. The user hereby waives the claim or defense that the foregoing courts constitute an inconvenient forum, and the user stipulates that the user has had minimum contacts with the State of Florida, Miami-Dade County, such that the user anticipates and intends to resolve any claims, litigation, or disputes by litigating in the State of Florida.
